The Supreme Court doesn’t give a piss what it costs this or that agency or state or whatever. That is never a concern or consideration of the Court. Congress has no other recourse in its approach. So-called “unfunded mandates” were held unconstitutional in the 90s. Congress can no longer require the states to do anything that may cost them money. So, Congress takes a different approach these days and threatens to withhold money from popular funding mechanisms in order to get the states to do what Congress desires. This is a bit like what I’ve seen in my friends’ marriages. Sure…you can do what you want. But, there WILL be a cost for it.
