It’s like a seesaw. And the question remains unsettled. There are fewer First Amendment reasons why than there are economic reasons why. Significant players in the industry (all the service providers as well as the larger social platforms such as Google, Facebook, and Twitter) will fight tooth and nail to prevent its industry from being pulled into the utilities sector. There are a couple of layers to this thing that makes the matter difficult to resolve. But I suspect that, inevitably, a version of public utility as it pertains to the internet (on the provider and on the user side) will prevail. Just my speculation though.
